Question that inspired this post:
I recently got my refusal letter for a Visitor Long Term Visa applied last week stating "There is a risk of misuse of the visa purpose in France after visa expires". With this case, I would like to Appeal and submit additional documents to prove there will be no risk as such. Do I need to appoint an immigration lawyer to handle the case (in this case I will be charged a lot of lawyer fees), or I can try to submit a letter of Appeal plus the additional documents? The appeal shall be submitted to CRRV Nantes. How long does it take before the decision of the appeal? I am applying from UAE. I already lived in Paris last year for 7 months whilst taking my Diploma in Le Cordon Bleu Paris. I guess, just need to submit more documents to support my Long Term Visitor Visa. Just left Paris 2 months ago.

"If that is the case normally you should be granted, I travelled thrice with 3 short-term visas to France and was automatically granted a long-term visit visa and long-term stay on my 4th Demand."
"Hi, in general, I advise assessing the possibility of re-filing before considering an appeal. Sometimes, depending on your request and the reasons given by the consulate, it may be more appropriate to examine what they are not satisfied with, strengthen the file and re-file. There is no waiting period for re-filing, and you often get a quicker result when you re-file than when you file an appeal."

If you have received a refusal for your Visitor Long Term Visa due to concerns about the risk of misuse after the visa expires, you have the option to appeal the decision. Here's how you can proceed:
Filing an Appeal: You can submit an appeal to the Commission de Recours contre les Décisions de Refus de Visa (CRRV) in Nantes. This is a mandatory step before you can take any further legal action. The appeal must be submitted within 2 months from the date you received the refusal notification.
Preparing the Appeal: You can write and submit the appeal yourself. The appeal letter should be clear, concise, and written in French. It should address the reasons for the refusal and include any additional supporting documents that demonstrate there is no risk of misuse of the visa purpose. These documents might include:
Proof of strong ties to your home country (e.g., employment contracts, property ownership)
Evidence of sufficient financial means
A detailed itinerary of your stay
Return flight tickets
Proof of accommodation.
Hiring a Lawyer: While it is not mandatory to hire an immigration lawyer, consulting one can be beneficial, especially if your case is complex or if you want to ensure that your appeal is as strong as possible. However, this can be costly, and many people successfully submit appeals on their own.
Processing Time: The CRRV typically takes about 2 months to process appeals. If the appeal is rejected or if you do not receive a response within this period, you can then appeal to the Administrative Court of Nantes, which can take an additional 6 to 12 months for a decision.
Next Steps if Rejected: If your appeal to the CRRV is unsuccessful, you can proceed by appealing to the Administrative Court of Nantes. This step is necessary if you wish to contest the decision further.
By carefully preparing your appeal and providing strong evidence to counter the reasons for refusal, you increase your chances of a successful outcome.
