Question that inspired this post:
Hello Everyone
I was on CDD for 18 months and am now beneficiary from Pole emploi for the next 10 months but my visa 'APS: premier titre de sejour portant salarie(recipesse)' is expiring in mid-July, I made an appointment to the prefecture and they refused to extend saying you need to have a contract from a company otherwise you have to leave France.
my question can I get an extension based on pole emploi considering the cdd contract also if not what option do I have can I enrol in a university or 'auto-entrepreneur'? to stay in France?
Thank you
Answer

Introduction
Navigating visa issues in France can be challenging, especially when your current visa is nearing its expiration. If you're in a situation where your APS visa is about to expire, here are several potential avenues to explore to extend your stay in France.
Extending Your APS Visa with Pôle emploi Benefits
Unfortunately, extending your APS visa based solely on receiving unemployment benefits from Pôle emploi is unlikely. The APS visa is typically granted for one year after completing studies to look for work or start a business. Once that period expires, unemployment benefits alone may not be sufficient grounds for an extension.
Enrolling in a University Program
One potential option is to enrol in a university program in France, which would allow you to apply for a student visa. As a student, you would be permitted to work part-time (up to 964 hours per year). Here’s what you need to do:
Find a Course: Identify a full-time course that begins before your current visa expires.
Proof of Admission: Obtain proof of enrollment from the educational institution.
Financial Proof: Demonstrate that you have sufficient funds to support yourself.
Health Insurance: Ensure you have adequate health insurance coverage.
Apply for a Student Visa: Submit your application at the local Prefecture with all required documents.
Becoming an Auto-Entrepreneur
Another option is to register as an auto-entrepreneur (self-employed/freelancer) in France. This path involves several steps:
Register Your Business: Obtain a SIRET number by registering your business.
Business Plan: Develop a viable business plan.
Financial Proof: Provide evidence of financial resources.
Apply for a Visa: Apply for the "Entrepreneur/Profession Libérale" visa, which might require you to return to your home country for the application.
Exploring Employment-Based Extensions
If you can secure a job offer or employment contract, you may be able to extend your stay through an employment-based visa. Here are some strategies:
Immediate Job Search: Actively search for a job and secure a contract, even a temporary one.
Networking: Leverage professional networks and recruitment agencies to find employment quickly.
Job Urgency: Inform potential employers about the urgency of your visa situation.
Other Visa Options
Depending on your circumstances, other visa categories might be suitable:
Talent Passport: For highly qualified employees, innovative businesses, or other specialized categories. Each has specific eligibility criteria.
Temporary Leave: You might need to leave France temporarily to apply for a new visa from outside the country unless you can change your status before your APS visa expires.
Consult the Prefecture
Since the Prefecture has already refused an extension based on your current status, visiting them again with additional documentation or a clear plan might help. Clearly explain your new course of action, such as enrollment in a university or starting a business.
Seek Professional Help
Consider consulting with an immigration lawyer or a specialist in France who can provide tailored advice and assist with the visa application process. They may have additional insights or strategies based on your specific circumstances.
Immediate Steps to Take
Act Quickly: Whatever path you choose, begin immediately to ensure you have enough time to gather the necessary documents and complete any procedures.
Gather Documentation: Ensure you have all relevant documentation ready, such as proof of enrollment, business registration, or job offers.
Prepare Financial Proof: Have proof of financial means to support yourself during your stay in France.
Summary
Employment: Secure a job offer or employment contract.
Student Visa: Enroll in a recognized educational institution.
Auto-Entrepreneur: Register as self-employed and apply for a corresponding visa.
Consult Prefecture: Explain your new plans and provide additional documentation.
Professional Help: Seek advice from an immigration lawyer or specialist.
Taking immediate action and seeking professional guidance will help ensure you find the best pathway to extend your stay in France.
