Question that inspired this post:

I wanted to ask about the Renewal of TDS (Salarie). I made an application through the ANEF and I got a feedback as follows:

[Demande de complément

Bonjour,

When submitting the form for the renewal, I had already submitted an Attestation from my current employer on its letterhead stating my name/post/salary etc. Then is there another format for this?

On searching on the internet, it seemed that this was an attestation from the previous employer for a "Rupture de contrat" as I found on this link :

If anyone has done this procedure, could you please guide me.

Navigating the renewal process of your Titre de Séjour Salarié can be complex, especially when dealing with the administrative requirements of French immigration authorities. One common hurdle many expatriate employees encounter involves submitting the correct documents, particularly the attestation de l'employeur. If you've been asked to provide an attestation for your work permit renewal but received feedback that the format was incorrect, you're not alone. Here's everything you need to know about providing the right documentation.

Understanding the Importance of the Employer Attestation

When renewing your Titre de Séjour Salarié (work permit for salaried employees in France), you must prove that you are still employed under the same conditions as when your initial permit was granted. The French authorities require an attestation from your current employer to confirm your employment status and salary. This document helps ensure that you are still legally employed and meet all conditions for staying and working in France.

Common Misunderstanding: The Wrong Attestation Format

It's not uncommon for applicants to mistakenly submit an attestation that is not suitable for the renewal process. A common error is submitting the "Attestation employeur destinée à France Travail" (formerly used by Pôle Emploi), which is mainly intended for employment termination situations.

The prefecture will not accept this document for a renewal application because it is not relevant to proving your continued employment.

Instead, what you need is a very specific "Attestation de l'employeur" that follows the guidelines set out by the French Ministry of Labor. This document certifies that you are still employed by your company under the same conditions specified in your original work contract.

What the Correct Attestation Should Include

To avoid delays in your Titre de Séjour Salarié renewal, make sure the employer attestation includes the following details:

  1. Your Employment Status: Confirmation that you are currently employed by the company and that your contract remains active.

  2. Your Position: A statement specifying your job title and the nature of your employment.

  3. Your Salary: An exact figure reflecting your current salary, which should match what is stated in your contract and pay slips.

  4. Confirmation of Ongoing Employment: A declaration that your employment is continuing and not in a termination or transitional phase.

In addition to the attestation, you may be required to submit additional supporting documents such as:

  • Copies of your last three pay slips.

  • Your current employment contract.

  • The Déclaration Sociale Nominative (DSN) or other proof of your employer's social security declarations concerning you.

Steps to Obtain the Correct Attestation

To successfully renew your Titre de Séjour Salarié, here’s what you need to do:

  1. Contact Your Employer: Let them know that the previous attestation submitted was insufficient and that a specific format is required. This is crucial as your employer may not be aware of the distinction between different types of attestations.

  2. Request the Correct Format: Ask your employer to prepare the attestation following the prescribed format from the Ministry of Labor. If needed, your employer can consult the local prefecture or check official government resources to get the exact template.

  3. Submit Additional Documents: Along with the attestation, make sure you have your most recent pay slips, a copy of your current employment contract, and any other documents requested by the prefecture. Missing documents or incorrect submissions can delay your application.

  4. Upload the Documents to ANEF: Once you have the correct attestation and supporting documents, upload them to the ANEF (Administration Numérique pour les Étrangers en France) platform, where you manage your Titre de Séjour renewal application. Be sure to double-check that all documents are uploaded correctly and are legible.

Why Precision Matters

Providing the right attestation in the correct format is crucial for a smooth renewal process. The prefecture will review your application based on the documents you submit, and any discrepancies can lead to delays or even the rejection of your application. If you are unsure of any requirements, it's a good idea to contact the prefecture directly for clarification or consult the ANEF platform for updated guidelines.

Conclusion

Renewing your Titre de Séjour Salarié can feel like a bureaucratic maze, but with the right preparation, it doesn't have to be overwhelming. Understanding the distinction between different types of attestations and ensuring that your employer provides the correct format will help streamline the process and prevent unnecessary delays. By following the steps outlined above, you can ensure that you submit the required documentation accurately and on time.

Remember, the key is to communicate clearly with your employer and double-check that every document aligns with the prefecture’s expectations. If in doubt, don’t hesitate to reach out to the prefecture for further guidance.

Note: Always ensure you stay updated on the latest requirements by checking official government websites or contacting relevant authorities directly.
