How to Resolve a Missed Tax Return as a Foreigner in France

28 May 2024

The question that inspired this post:

Hello ! I have a question.

Last year I accidentally didn’t fill in my tax return, I’ve been here four years in November so I didn’t do my first year I then filled in 2021s report but was told after doing it first on paper it would then be done automatically online. I thought this meant I didn’t have to do a declaration, like in the UK. I found out this year that’s not true. I moved house last year so didn’t receive the letter asking me why I hadn’t done it so only found out through friends. This year I’ve gone to fill it out but I can’t help but worry about last year's error. I didn’t earn enough to be taxed but they don’t know that? What can I do to solve this?

I want to apply for my French passport next November when I have been here 5 years will this affect my application?

Introduction

It’s understandable to be concerned about missing a tax return, especially when planning to apply for French citizenship. Here’s how you can address the issue and ensure it doesn’t negatively impact your application.

Steps to Resolve the Missed Tax Return

  1. File the Missed Return Immediately:

  • Online Filing: Log into your account on the impots.gouv.fr website and file the tax return for the year you missed (2022 for the 2021 income). If you don't have an account yet, you can create one using your tax identification number.

  • Paper Filing: If you cannot file online, you can file a paper return. Download the necessary forms from the impots.gouv.fr website or pick them up from your local tax office.

  1. Contact Your Local Tax Office:

  • Inform them of the situation, explaining that you didn't receive the reminder due to your change of address and that you have already filed the missed return. They can provide guidance and might be more lenient regarding any potential penalties.

  1. Change of Address Notification:

  • Ensure your current address is updated with the tax authorities to avoid missing future communications. You can update your address on the impots.gouv.fr website.

  1. Check for Penalties:

  • Typically, late filing of a tax return may incur penalties. Given your circumstances and that you did not owe taxes, you may be able to request a waiver or reduction of penalties. Your local tax office can provide more information on how to proceed with this.

Impact on French Citizenship Application

When applying for French citizenship, the authorities review your tax records to ensure compliance with French laws. Here’s what you should consider:

  1. Rectify the Missed Return:

  • By filing the missed tax return and ensuring all future returns are submitted on time, you demonstrate your willingness to comply with French regulations.

  1. Explain the Situation:

  • During the citizenship application process, if asked, be transparent about the missed tax return. Explain the steps you took to rectify the situation and that it was an honest mistake.

  1. Financial Stability and Compliance:

  • As you didn’t earn enough to be taxed, this should be a mitigating factor. The key is showing that you have regularized the situation as soon as you become aware of it.

Additional Tips

  • Keep Records: Maintain copies of all correspondence with the tax authorities, your filed returns, and any proof of your updated address.

  • Seek Professional Advice: If you are unsure about any part of the process, consider consulting a tax advisor or legal professional who specializes in French tax law and citizenship applications.

By taking these steps, you should be able to resolve the missed tax return issue and ensure it doesn’t affect your application for French citizenship.
