My Attestation de Prolongation has expired. What should I do?

20/06/2024

Question that inspired this post:

Attestation de Prolongation

Hello. I am asking for a friend. He applied for a Carte de Sejour in January and received an attestation validating his Visa for a further 2 months, expiring at the end of April, whilst his carte was being prepared. He has not heard anything from his Prefecture and of course, the attestation has expired. What should he do?

Answers

"He should have received a text advising him to make an appt. to pick up his card. I'm assuming he didn't see it. He needs to go to his Prefecture and explain. I don't what they will decide to do."

"ADP is not same as AFD. If he has ADP, then it means his application is still being processed so his card cannot be issued. The card would only be processed if he has gotten an Attestation of a Favourable Decision.

He can send them a message through ANEF to request a new ADP."

Introduction

When waiting for a Carte de Séjour (residence permit) in France, it’s not uncommon for the temporary attestation (extension certificate) to expire before receiving the final permit. If you find yourself in this situation, don’t worry. Here’s a detailed guide to help you navigate this issue effectively.

Immediate Follow-Up with the Prefecture

1. Contact the Prefecture

The first step is to contact your local prefecture immediately. You can do this via phone, email, or by visiting in person. Explain your situation clearly: your attestation has expired, and you have not received any updates on your Carte de Séjour application.

2. Proof of Application

Make sure to bring or mention all relevant documents. This includes any proof of your initial application submission and the expired attestation. Having all relevant documents ready, including the initial receipt of the application and any correspondence with the prefecture, is crucial.

Requesting a New Attestation

1. Attestation de Prolongation

You should request an Attestation de Prolongation or a temporary extension document. This document will legally extend your stay in France and provide proof of your status while your Carte de Séjour is being processed.

Documentation Preparation

1. Documents to Prepare

Ensure you have the following documents ready for the prefecture:

  • Expired attestation

  • Proof of application for the Carte de Séjour

  • Passport with visa

  • Proof of residence

  • Any other correspondence from the prefecture

Having these documents organized and ready will help expedite the process.

Follow-Up Strategy

1. Regular Checks

Regularly check the status of your application. Some prefectures have online portals where you can monitor the progress. This will help you stay informed about any updates or additional requirements.

2. Persistent Follow-Up

If you do not receive a response after the initial contact, follow up persistently. This can involve visiting the prefecture again or making regular phone calls to ensure your case is being processed.

Seeking Assistance

1. Legal Assistance

If you still do not receive a response or face difficulties, consider seeking assistance from an immigration lawyer or an association that helps with administrative processes for foreigners. They can provide specialized guidance and support to ensure your case is handled properly.

Dear [Prefecture Name] Team, I hope this message finds you well. I am writing to follow up on my Carte de Séjour application submitted in January [Reference Number if available]. Please find attached copies of my expired attestation, proof of application submission, and my passport for your reference. I would appreciate it if you could expedite the processing of my Carte de Séjour and provide me with a new attestation as soon as possible. Thank you for your understanding and assistance.

Best regards,
