Navigating APS Issues in France: Resolving Work Authorization Documentation Confusion

Dernière mise à jour : 5 nov. 2024

Question that inspired this post(posted on 23/10/2024):

I am currently on my second APS, and I signed a contract, my manager has applied for my Autorisation de travail, under the category that mentions that I have an Autorisation Provisionaire as earlier when he applied under titre de sejour, it was not getting accepted.

But now after submitting all the required documents, they ask him my scolarite for the year 2024/2025, and how is it even possible because I get an APS only after my degree, plus I am on my second APS.  Can you please help me out as to what can be explained to prefecture in this situation?

I tried calling their English helpline as well as French but nobody picked up.

In your situation, it seems there is some confusion at the prefecture regarding the documentation required for your work authorization application.

Since you are on your second Autorisation Provisoire de Séjour (APS), which is typically granted after completing your studies, the request for proof of enrollment for the academic year 2024/2025 appears to be an error or misunderstanding.

Here are some steps you can take to clarify and resolve the issue:

  1. Clarify Your Status: Explain to the prefecture that you have completed your studies and are on your second APS. The APS is specifically for graduates to search for employment or start a business in France, and it does not require current enrollment in an educational program.

  2. Provide Relevant Documentation: Ensure that all relevant documents are submitted, including:

    1. A copy of your diploma or attestation de réussite (certificate of completion) from your educational institution.

    2. Your current APS documentation.

    3. Any previous correspondence or documentation related to your APS applications.

  3. Written Explanation: Consider writing a formal letter explaining your situation. Highlight that the APS is granted post-graduation and that you have already completed your studies, thus making the request for current school enrollment irrelevant.

  4. Seek Assistance: If possible, seek help from a legal advisor or an organization specializing in expatriate issues in France. They might offer additional insights or assist in communicating with the prefecture.

  5. Contact Methods: If phone calls are unanswered, try visiting the prefecture in person if feasible. Alternatively, use any available online contact forms or email addresses to explain your situation and request clarification.

By taking these steps, you should be able to provide the necessary information to correct any misunderstandings with the prefecture regarding your APS status and application for work authorization.
